These terms govern your use of this website. Please read them carefully. They are provided in line with South African law, including the Electronic Communications and Transactions Act.

These Terms of Use (the "Terms") govern your access to and use of the website at africantechno.com and its subpages (the "Website"), operated by African Technopreneurs (Pty) Ltd ("African Technopreneurs", "we", "us" or "our"). By accessing or using the Website you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.

These Terms are recorded in accordance with the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and take effect as a valid and binding agreement between you and us.

Where you submit an enquiry, quote request or demo booking, you undertake to provide accurate, current and complete information. Submitting an enquiry does not create a binding agreement. Any quotation, availability or service is subject to confirmation by us and to the separate terms applicable to that service. Product purchases are concluded on our online store, 180by2, under its own terms and conditions.

All content on the Website, including text, graphics, logos (including the African Technopreneurs name and mark), images, video, layout and design, is owned by or licensed to us and is protected by South African and international intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, adapt or commercially exploit any content without our prior written consent.

The Website links to third-party websites and to our related properties, including our AI services platform at ai.africantechno.com, our online store 180by2, and the EARN Group. Those properties are governed by their own terms and privacy policies. We are not responsible for the content, products, services or practices of any third-party website, and links do not imply our endorsement of them.

The Website and its content are provided on an "as is" and "as available" basis. To the extent permitted by law, and subject to your rights under the Consumer Protection Act 68 of 2008 where it applies, we make no warranties or representations, express or implied, regarding the Website, including as to accuracy, completeness, reliability or uninterrupted availability. Information on the Website is general in nature and does not constitute professional, legal, financial or technical advice.

8. Limitation of liability

To the maximum extent permitted by law, African Technopreneurs, its directors, employees and agents will not be liable for any direct, indirect, incidental, special or consequential loss or damage, of any kind, arising out of or in connection with your use of, or inability to use, the Website, your reliance on any content, or any third-party website linked from the Website. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act or for loss caused by our gross negligence or wilful misconduct.

You indemnify and hold us harmless against any claims, losses, damages, costs and expenses arising from your breach of these Terms, your unlawful use of the Website, or your infringement of any third-party rights.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy. By submitting an enquiry you consent to the processing of your personal information as described in that policy.

11. Electronic communications

You consent to receiving communications from us in electronic form, and you agree that agreements, notices, disclosures and other communications provided electronically satisfy any legal requirement that they be in writing. Data messages and electronic transactions have legal force and effect in accordance with ECTA.

12. Consumer Protection Act

Where the Consumer Protection Act 68 of 2008 applies to your dealings with us, nothing in these Terms is intended to limit, exclude or waive any right you have under that Act. Consumer transactions concluded through our online store are subject to that store's terms and to the Consumer Protection Act.

13. Availability and changes to the Website

We may change, suspend or discontinue the Website, or any part of it, at any time and without notice. We do not guarantee that the Website will be available at all times or free of errors.

We may amend these Terms from time to time. The current version is the one published on this page, together with its "last updated" date. Your continued use of the Website after any change constitutes acceptance of the amended Terms.

15. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the South African courts, and, where a matter falls within its jurisdiction, the Magistrate's Court, in respect of any dispute arising from your use of the Website.

16. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the whole agreement between you and us in relation to your use of the Website. Our failure to enforce any right does not amount to a waiver of that right.
